IMPORTANT LEGAL NOTICE REGARDING THIS POLICY

IMPORTANT! PLEASE CAREFULLY READ THIS DYNASTY REWARDS RULES & POLICY BEFORE PARTICIPATING IN THE DYNASTY REWARDS PROGRAM AND BEFORE REDEEMING OR ATTEMPTING TO REDEEM ANY CROWNS, AS THIS POLICY AFFECTS YOUR LEGAL RIGHTS AND OBLIGATIONS.

CUSTOMER AGREEMENT

DraftKings Inc. and/or its affiliate(s) (individually and collectively, “DraftKings”) are pleased to offer DraftKings and Golden Nugget Online Casino Customers access to the Global Promotional Sourcing catalog and the opportunity to redeem Crowns (as defined herein) for Rewards (as defined herein) via the Dynasty Rewards Program (“Program”). Your use of and access to the Global Promotional Sourcing catalog, and the ability to redeem Crowns for Rewards thereon, is subject to and governed by this Dynasty Rewards Rules & Policy (“Policy”), the DraftKings’ Privacy Notice (available by clicking HERE) (“Privacy Notice”), the DraftKings Daily Fantasy Sports Terms of Use (available by clicking HERE) (“DFS Terms of Use”), the DraftKings Pick6 Terms of Use (available by clicking HERE) (“Pick6 Terms of Use”), the Terms of Use of DraftKings Sportsbook for the applicable state you are physically located in while participating in the Program (available by clicking HERE) (“Sportsbook Terms of Use”), the Terms of Use of DraftKings Sportsbook and Casino for the applicable state you are physically located in while participating in the Program (available by clicking HERE) (“DK Sportsbook and Casino Terms of Use”), the Terms of Use of Golden Nugget Online Casino for the applicable state you are physically located in while participating in the Program (available by clicking HERE) (“GN Casino Terms of Use”), and the DraftKings Horse Terms of Use (available by clicking HERE) (“Horse Terms of Use, and, together with the DFS Terms of Use, the Pick6 Terms of Use, the Sportsbook Terms of Use, the DK Sportsbook and Casino Terms of Use, and the GN Casino Terms of Use the “Terms of Use”), each as amended from time to time and incorporated herein (this Policy, the Privacy Notice, and the Terms of Use shall collectively be referred to as the “Agreement”). DraftKings reserves the right to modify, suspend, or terminate this Policy, the Program, the provision of Crowns, the Tier Credits thresholds described herein, the availability of Rewards, and the number of Crowns needed for any given Reward at any time and without notice, effective immediately, and it is your responsibility to review this Policy for any modifications. Your continued participation in the Program constitutes your acceptance of any modifications to this Policy.

ACCEPTANCE

You agree to the provisions of this Policy by your participation in the Program (including, without limitation, by affirmative confirmation on the Dynasty Store or elsewhere, by redeeming or attempting to redeem Crowns, or by accessing, engaging with, or using the Global Promotional Sourcing catalog via any DraftKings site or for any purpose related to this Program). IN THE EVENT YOU DO NOT AGREE TO BE BOUND BY THIS POLICY, DO NOT PARTICIPATE IN THE PROGRAM. In the event you wish to be excluded from the Program, you must contact support@draftkings.com and terminate your DraftKings Customer account and Golden Nugget Online Casino Customer account. By participating in the Program, you acknowledge that you have read and agreed to the provisions set forth in this Policy without modification thereto. This Agreement constitutes a legal agreement between you and DraftKings and shall apply and be binding on you even after termination of your DraftKings Customer account and Golden Nugget Online Casino Customer account, the termination of this Policy, or the suspension or termination of the Program.

CROWNS
Crowns are a form of player loyalty points (“Crowns”). Individuals with an active and valid DraftKings account or Golden Nugget Online Casino account created and maintained pursuant to the applicable Terms of Use will be automatically enrolled in the Program and eligible to earn Crowns, subject to any requirement for eligibility set forth herein (such individuals, “Customers”). A Customer’s Crowns balance may be revoked, expired, reduced, and/or modified by DraftKings in its sole and absolute discretion, at any time, for any reason or no reason. Once Crowns are earned by the Customer and reflected in the Customer’s account, Crowns may be redeemed for site credits and contest entry, used on the DraftKings Shop, and/or redeemed through Global Promotional Sourcing’s catalog (the “Dynasty Store”) for merchandise, travel, event tickets, experiences, and/or charitable donations (site credits, contest entry, and the rewards available at the Dynasty Store, individually and collectively, “Reward(s)”). All Customers acknowledge that Rewards may not be available and are subject to change and/or removal from time to time by DraftKings in its sole and absolute discretion, and for any reason or for no reason, with or without notice to Customers, and Customers hereby waive any claim and/or rights to and associated with any Rewards. Furthermore, each Customer may be subject to and/or required to accept policies or terms of use with third-party rewards providers in order to redeem Crowns and/or receive Rewards. All taxes, fees, surcharges, incidentals, and other costs associated with Rewards shall be borne solely by the Customer.

Crowns may be earned by a Customer by completing the following actions: (i) entering into a paid DraftKings daily fantasy sports contest pursuant to the DFS Terms of Use, (ii) placing a paid wager that has greater than -300 odds (e.g., -200 odds or +150 odds are greater than -300 odds) in the DraftKings online sportsbook pursuant to the Sportsbook Terms of Use, (iii) placing a paid wager in the DraftKings online casino pursuant to the DK Sportsbook and Casino Terms of Use, (iv) placing a paid wager in the Golden Nugget online casino pursuant to the GN Casino Terms of Use, (v) entering a paid DraftKings Pick6 contest pursuant to the DraftKings Pick6 Terms of Use, and/or (vi) placing a paid wager through DraftKings Horse pursuant to the DK Horse Terms of Use and the Terms and Conditions available by clicking HERE ((i)-(vi) each a “Crown Earning Activity”). To access the Dynasty Store, a Customer may follow an associated link on the applicable DraftKings or Golden Nugget Online Casino site to the Program landing page from which the Customer may then follow third-party links to access the Dynasty Store. The Dynasty Store and the associated hosting site(s) are controlled and maintained by third party(ies), and DraftKings is not responsible for the Dynasty Store or any associated hosting site(s).

The provision, duration, value, expiration, and/or revocation of Crowns may be modified at any time in DraftKings’ sole and absolute discretion, for any reason or no reason. Crowns will be automatically credited to the Customer’s Crown balance. Crowns will accrue on a fractional basis; however, a Customer’s Crown balance will only display the total Crown amount as a whole number (rounded down). Crowns accrued on the Customer’s DraftKings account, including without limitation, Crown accrued on DK Horse, will be reflected in their DraftKings account Crowns balance, while Crowns accrued on the Customer’s Golden Nugget Online Casino account will be reflected separately in their Golden Nugget Online Casino Crowns balance. Crowns are not transferable between a Customer’s DraftKings account and their Golden Nugget Online Casino Account. Crowns do not expire, unless stated otherwise by DraftKings, in DraftKings sole and absolute discretion, for any reason or no reason. Customers may view their Crown balance at any time on any DraftKings site, including, DK Horse, or on any Golden Nugget Casino site. The rate at which Crowns are accrued varies based on contest, wager, bet type, or entry fee. DraftKings reserves the right, in its sole and absolute discretion, for any reason or no reason, and without notice, to modify the number of Crowns required to obtain any Reward. The redemption value of Crowns is determined by DraftKings and/or the applicable cost in the Dynasty Store at the time at which the Crowns are redeemed by the Customer. The accumulation of Crowns does not entitle Customers to any vested rights with respect to any Rewards.

CROWNS ACCRUAL RATES

All Crown accrual rates are subject to change by DraftKings in its sole and absolute discretion, for any reason or no reason, at any time and without notice.

Crowns may accrue at the following rates:

Sportsbook:

• Customers may be eligible to receive one (1) Crown for every six US dollars ($6) wagered through the DraftKings online sportsbook on wagers with odds -300 or greater (e.g., -200 odds or +150 odds are greater than -300 odds);
• Customers may be eligible to receive two times (2x) the Crowns for wagers through the DraftKings online sportsbook with odds between -125 and +200;
• Customers may be entitled to receive four times (4x) the Crowns for wagers through the DraftKings online sportsbook with odds between +200 and +500; and
• Customers may be eligible to receive eight time (8x) the Crowns for wagers through the DraftKings online sportsbook with odds of +500 or greater (e.g., +600 odds are greater than +500 odds).

Daily Fantasy Sports Contests (including DraftKings Pick6):

• Customers may be eligible to receive one (1) Crown for every two US dollars ($2) spent to enter a contest on the DraftKings daily fantasy sports or DraftKings Pick6 products.

Casino (DraftKings Casino or Golden Nugget Online Casino):

• Customers may be eligible to receive one (1) Crown for every two US dollars ($2) wagered on most slots on the DraftKings casino product or Golden Nugget Online Casino product;
• Customers may be eligible to receive one (1) Crown for every eight US dollars ($8) wagered on most casino table games and video poker on the DraftKings casino product or Golden Nugget Online casino product; and
• Customers may be eligible to receive one (1) Crown for every five US dollars ($5) wagered on select tables games and slots on the DraftKings casino product or Golden Nugget Online casino product.

DK Horse:

• Customers may be eligible to receive one (1) Crown for every four US dollars ($4) wagered through DK Horse.

Crowns for spend in Canadian Dollars will accrue at 0.8 times the US Dollar rates listed above (e.g., Customers may be eligible to receive one (1) Crown for every seven dollars and fifty cents CAD ($7.50) wagered on DraftKings Sportsbook at -300 odds or greater).

Certain slots, table games, and/or video poker games may have different Crown accrual rates than as set forth above. In the event you have questions related to the Crowns accrual rate for a particular slot, table game, and/or video poker game, contact support@DraftKings.com. DraftKings may modify, suspend, and/or terminate the number of Crowns that can be accrued at any time and without notice, in its sole and absolute discretion, for any reason or no reason, including, without limitation, the number of Crowns that can be accrued through a particular slot or table game or sportsbook wager type.

Crowns may be distributed as follows:
Sportsbook:

• Crowns may be distributed at the time of settlement of the associated wager. Sportsbook wagers that are cashed-out, push, voided, or otherwise canceled do not accrue Crowns.

Daily Fantasy Sports Contests (including DraftKings Pick6):

• Crowns may be distributed at the time that the associated contest locks (i.e. the time at which no additional contest entries will be accepted) (in the event a Contest is canceled after it is locked, DraftKings reserves the right to revoke Crowns earned therefrom in its sole and absolute discretion, for any reason or no reason).

Casino (DraftKings Casino or Golden Nugget Online Casino):

• Crowns may be distributed at the time the associated wager is entered on slots on the DraftKings casino product or Golden Nugget Online casino product; and
• Crowns may be distributed at the time the associated wager is entered on casino table games and video poker on the DraftKings casino product or Golden Nugget Online casino product.

DK Horse:

• Crowns may be distributed at the time of settlement of the associated wager.

TIER CREDITS

Tier Credits are a form of player loyalty points (“Tier Credits”). Customers with an active and valid DraftKings account and/or Golden Nugget Online Casino account created and maintained pursuant to the applicable Terms of Use will be eligible to earn Tier Credits, subject to any requirement for eligibility set forth herein. A Customer’s Tier Credits balance may be revoked, reduced, and/or modified by DraftKings at any time in DraftKings sole and absolute discretion, for any reason or no reason.

Tier Credits may be earned by a Customer by completing the following actions: (i) entering into a paid DraftKings daily fantasy sports contest pursuant to the DFS Terms of Use, (ii) placing a paid wager that has greater than -300 (e.g., -200 odds or +150 odds are greater than -300 odds)  odds in the DraftKings online sportsbook pursuant to the Sportsbook Terms of Use, (iii) placing a paid wager in the DraftKings online casino pursuant to the DK Sportsbook and Casino Terms of Use, (iv) placing a paid wager in the Golden Nugget online casino pursuant to the GN Casino Terms of Use, (v) entering a paid DraftKings Pick6 contest pursuant to the DraftKings Pick6 Terms of Use, and/or (vi) placing a paid wager through DraftKings Horse pursuant to the DK Horse Terms of Use and the Terms and Conditions available by clicking HERE  ((i)-(vi) each a “Tier Credits Earning Activity”).

The provision, duration, value, and/or revocation of Tier Credits may be modified at any time in DraftKings’ sole and absolute discretion for any reason or no reason. Tier Credits will be automatically credited to the Customer’s Tier Credit balance. A Customer’s Tier Credit balance will include Tier Credits earned across both their DraftKings account and their Golden Nugget Online Casino account in the event the Customer has both a DraftKings account and a Golden Nugget Online Casino account. Tier Credits will accrue on a fractional basis; however, a Customer’s Tier Credit balance will only display the total Tier Credit amount as a whole number (rounded down). Customers may view their Tier Credit balance at any time on any DraftKings site or on any Golden Nugget Online Casino site. The rate at which Tier Credits are accrued varies based on contest, wager, bet type, entry fee, or purchase price. The accumulation of Tier Credits does not entitle Customers to any vested rights with respect to any Rewards.

TIER CREDIT ACCRUAL RATES

All Tier Credit accrual rates are subject to change by DraftKings in its sole and absolute discretion, for any reason or no reason, at any time and without notice. Customers will not accrue Tier Credits for any wagers on the Golden Nugget Online casino product while the Customer is physically located in New Jersey.

Tier Credits may accrue at the following rates:

Sportsbook:Customers may be eligible to receive one (1) Tier Credit for every five US dollars ($5) wagered through the DraftKings online sportsbook on parlay wagers and Same Game Parlay wagers with eligible odds, as specified herein; and

• Customers may be eligible to receive one (1) Tier Credit for every ten US dollars ($10) wagered on the DraftKings online sportsbook on all other sportsbook wagers (e.g., without limitation, non-parlay, straight bets, futures) with eligible odds, as specified herein.

Daily Fantasy Sports Contests (including DraftKings Pick6):

• Customers may be eligible to receive one (1) Tier Credit for every five US dollars ($5) spent to enter a contest on the DraftKings daily fantasy sports or DraftKings Pick6 products.

Casino (DraftKings Casino or Golden Nugget Online Casino):

• Customers may be eligible to receive one (1) Tier Credit for every ten US dollars ($10) wagered on most slots on the DraftKings casino product or Golden Nugget Online Casino product;
• Customers may be eligible to receive one (1) Tier Credit for every forty US dollars ($40) wagered on most casino table games and video poker on the DraftKings casino product or Golden Nugget Online Casino product; and
• Customers may be eligible to receive one (1) Tier Credit for every twenty-five US dollars ($25) wagered on select tables games and slots or Golden Nugget Online Casino product.

DK Horse:

• Customers may be eligible to receive one (1) Tier Credit for every four US dollars ($4) wagered through DK Horse.

Tier Credits for spend in Canadian Dollars All Tier Credit accrual rates are subject to change by DraftKings in its sole and absolute discretion, for any reason or no reason, at any time and without notice. Customers will not accrue Tier Credits for any wagers on the Golden Nugget Online casino product while the Customer is physically located in New Jersey.

• Customers may be eligible to receive one (1) Tier Credit for every eighteen US dollars ($18) wagered through the DraftKings online sportsbook on wagers with odds -300 or greater (e.g., -200 odds or +150 odds are greater than -300 odds);
• Customers may be eligible to receive two times (2x) the Tier Credits for wagers through the DraftKings online sportsbook with odds between -125 and +200;
• Customers may be eligible to receive four times (4x) the Tier Credits for wagers through the DraftKings online sportsbook with odds between +200 and +500; and
• Customers may be entitled to receive eight times (8x) the Tier Credits for wagers through the DraftKings online sportsbook with odds of +500 or greater (e.g., +600 odds are greater than +500 odds).

Daily Fantasy Sports Contests (including DraftKings Pick6):

• Customers may be eligible to receive one (1) Tier Credit for every five US dollars ($5) spent to enter a contest on the DraftKings daily fantasy sports or DraftKings Pick6 products.

• Customers may be eligible to receive one (1) Tier Credit for every ten US dollars ($10) wagered on most slots on the DraftKings casino product or Golden Nugget Online Casino product;
• Customers may be eligible to receive one (1) Tier Credit for every forty US dollars ($40) wagered on most casino table games and video poker on the DraftKings casino product or Golden Nugget Online Casino product; and
• Customers may be eligible to receive one (1) Tier Credit for every twenty-five US dollars ($25) wagered on select tables games and slots or Golden Nugget Online Casino product.

DK Horse:

• Customers may be eligible to receive one (1) Tier Credit for every twenty US dollars ($20) wagered through DK Horse.

Tier Credits for spend in Canadian Dollars will accrue at 0.8 times the US Dollar rates listed above (e.g. Customers may be eligible to receive one (1) Tier Credit for every twenty-two dollars and fifty cents CAD ($22.50) wagered on DraftKings Sportsbook at -300 odds or greater).

• Tier Credits may be distributed at the time the associated wager is entered on casino table games and video poker on the DraftKings casino product or Golden Nugget Online Casino product.

DK Horse:

• Tier Credits may be distributed at the time of settlement of the associated wager.

TIERS AND ASSOCIATED PERKS

Beginning January 3, 2025, a Customer may be placed in a particular tier for a calendar year based upon the number of Tier Credits the Customer earned in such calendar year. For purposes of calculating a Customer’s tier status and accrued Tier Credits, (i) the calendar year begins on January 3 at 12:00:01 A.M. prevailing Pacific Time (“PT”) and ends on January 3 at 11:59:59 P.M. PT of the following calendar year; and (ii) Tier Credits counts and tier status reset at the end of each calendar year. DraftKings may, in its sole and absolute discretion for any reason or no reason, revoke or modify a Customer’s tier status and/or withhold, revoke, or require the return of any prizes, gifts, and/or rewards awarded or given to a Customer in connection with the Customer’s tier status.

1. Some wagers are not eligible to earn Crowns or Tier Credits. These include: wagers made on Live Dealer Craps; and sportsbook wagers at less than -300 odds (e.g., -2500).
2. Dynasty Store, Tier Credit Milestone Rewards, Crowns Boosts, and Weekly Casino Rewards are not currently available outside the United States & Canada7
3. Game of the Week and Games of the Month for DK Casino and Golden Nugget Online Casino are listed at https://casino.draftkings.com/dynasty-rewards-crowns-boost-cas and https://www.goldennuggetcasino.com/dynasty-rewards-crowns-boost respectively.
4. Access to VIP hosting is not available to, and may be discontinued for, the following Customers:

   1. customers with a residential address outside of the United States or Canada;

   2. Customers who have not opted into receiving marketing communications from DraftKings or are ineligible to receive marketing from DraftKings;
   3. Customers who have declined VIP hosting or requested not to be contacted by DraftKings and/or a VIP Host
   4. Customers identified by DraftKings with potential responsible gaming or fraud concerns, as determined by DraftKings in its sole and absolute discretion for any reason or no reason;
   5. Users who have reached their status tier due to an override and not by accruing Tier Credits are not eligiblet;
   6. Customers who have had their play on DraftKings limited by DraftKings, as determined by DraftKings in its sole and absolute discretion for any reason or no reason;
   7. Customer who have not placed a wager or entered a contest on DraftKings for more than ninety (90) days;
   8. Customers who have abused their VIP hosting privileges or have been abusive, threatening or harassing to their VIP host, DraftKings, or any DraftKings employee, in each case, as determined by DraftKings in its sole and absolute discretion for any reason or no reason;
   9. Customers suspected of violating any terms of use of DraftKings, as determined by DraftKings in its sole and absolute discretion for any reason or no reason; and
   10. customers under the age of twenty one (21)
       
5. Users who have reached their status tier due to an override and not by accruing Tier Credits are not eligible for the Diamond Annual Gift or the Onyx Elite Reward unless they reach the tier by accruing Tier Credits.

Elite Rewards

Customers in the Diamond and Onyx tiers may be eligible to participate in the Elite Rewards portion of the Program (“Elite Rewards”) where Customers may be eligible to select and receive additional merchandise, travel, event tickets, and experiences (“Elite Rewards Gifts”). Only Customers in the Diamond and Onyx tiers are eligible to participate in Elite Rewards portion of the Program, and Customers who have been gifted Diamond or Onyx tier status or status extension are not eligible to participate in Elite Rewards. To be eligible to participate in the Elite Rewards Portion of the Program, Customers must receive an invitation from DraftKings to participate in Elite Rewards, and the offer to participate in Elite Rewards is only valid for the intended recipient. Individuals or Customers who receive an offer to participate in Elite Rewards via an email forward, screenshot, or other means shall not be eligible to participate in the Elite Rewards portion of the Program. DraftKings may, in its sole and absolute discretion, for any reason or no reason, revoke a Customer’s participation in the Elite Rewards portion of the Program, revoke any Elite Rewards Gifts, and/or require the return of any Elite Rewards Gifts.

Customers in the Diamond tier participating in the Elite Rewards portion of the Program receive the opportunity to select one (1) Elite Rewards Gift from a selection of Elite Rewards Gifts determined at DraftKings sole discretion, for any reason or no reason. Customers in the Onyx tier participating in Elite Rewards are eligible to receive Elite Gifts and Experience Credits which are a form of player loyalty points (“Elite Rewards Credits”) that can be redeemed for Elite Rewards Gift(s) from a selection of Elite Rewards Gifts determined at DraftKings sole discretion. For clarity, only Customers in the Onyx tier who are participating in the Elite Rewards portion of the Program are eligible to receive Elite Rewards Credits. Elite Rewards Credits have no monetary value whatsoever. Elite Rewards Credits may be earned by earning Tier Credits and are based on the eligible Customer’s total accumulated tier credits between January 3 at 12:00:01 A.M. PT and January 3 at 11:59:59 P.M. PT of the following calendar year as set forth below:

For every two hundred fifty thousand (250,000) Tier Credits an eligible Customer in the Onyx tier participating in Elite Rewards earns above one million (1,000,000) Tier Credits, such Customer is eligible to receive an additional one (1) Elite Rewards Credit. A Customer’s Elite Rewards Credits balance may be revoked, expired, reduced, and/or modified by DraftKings in its sole and absolute discretion, at any time, for any reason or no reason.

Elite Reward Gifts and/or Elite Reward Credits that are earned after January 3 at 12:00:01 A.M. PT of a calendar year must be selected and/or redeemed by January 28 at 11:59:59 P.M. Eastern Prevailing Time of the following calendar year or the Elite Reward Gifts and/or Elite Reward Credits will be forfeited.

All Customers participating in Elite Rewards portion of the Program acknowledge that Elite Rewards Gifts may not be available, are available while supplies last, and are subject to change and/or removal from time to time by DraftKings in its sole and absolute discretion, for any reason or for no reason, with or without notice to Customers. Customers participating in Elite Rewards portion of the Program hereby waive any claim and/or rights to and associated with any Elite Rewards Gifts. Furthermore, each Customer participating in the Elite Rewards portion of the Program may be subject to and/or required to accept additional policies, assumption of risk or waivers, and/or terms of use, including, without limitation, with third-party providers, in order to redeem Elite Rewards Credits and/or receive Elite Rewards Gifts. Elite Rewards Gift redemptions are handled by a third party and may be subject to the third-party’s own terms and conditions. Third-party partners are not under DraftKings’ control and DraftKings will not be responsible or liable in any form for Customer’s redemption and use of Elite Rewards Gifts through the third party partner. Elite Rewards Gifts and Elite Rewards Credits are non-cashable, non-transferable, and cannot be exchanged.

All taxes, fees, surcharges, incidentals, and other costs associated with Elite Rewards Gifts and/or the redemption of Elite Rewards Credits shall be borne solely by the Customer.

DraftKings reserves the right to revoke a Customer’s participation in the Elite Rewards portion of the Program and/or revoke or reduce a Customer’s Elite Reward Credit balance as the result of fraudulent activity or in DraftKings’ sole and absolute discretion, for any reason or no reason.

LIMITATIONS ON CROWNS

Crowns have no monetary value whatsoever. Crowns redeemed by a Customer for a Reward may only be refunded under certain circumstances, as determined by DraftKings in its sole and absolute discretion for any reason or no reason.

Customers shall not sell, barter, assign, bequeath, transfer (by intestate succession or otherwise), redeem for cash, give away, donate, or advertise for sale or barter of any kind, any Crowns, and all of a Customer’s Crowns shall be rendered void in the event transferred by the Customer in any way. Crowns cannot be transferred by the Customer by operation of law, such as by inheritance, in bankruptcy, or in connection with a divorce or other legal claim or proceeding. Customers may not pool Crowns or combine Crown balances. The sale or barter, or the attempted sale or barter, of Crowns by a Customer is prohibited. Crowns may not be used by a Customer in conjunction with any other promotion, coupon, discount, or special offer. DraftKings reserves the right to revoke Crowns from a Customer as the result of fraudulent activity or in DraftKings’ sole and absolute discretion, for any reason or no reason. Each Customer will be responsible for any taxes associated with such Customer’s redemption of Crowns for Rewards.

In the event a Customer’s account is voluntarily or involuntarily closed or terminated, all Crowns associated with that account will be forfeited.

In the event a Customer’s account is voluntarily or involuntarily closed or terminated, all Tier Credits and the Customer’s tier status associated with that account will be forfeited.

CROWNS, ELITE REWARDS GIFTS, AND ELITE REWARD CREDIT REDEMPTION

Subject to the existence of, and the terms and conditions of, any agreement in place between DraftKings and third-party rewards provider(s), Customers may be eligible to redeem Crowns in exchange for Rewards, including those listed in the Dynasty Store, with such third-party reward provider. Customers are only eligible for Rewards and Elite Rewards Gifts in the event the Customer has fully complied with all applicable terms, conditions, and rules, including, without limitation, those set forth in the Agreement. All travel, lodging, and all other costs and expenses associated with a Reward or Elite Rewards Gift, including, without limitation, incidental travel costs associated with the Reward or Elite Rewards Gift, meals, passenger tariffs or duties, airline fees, surcharges, airport fees, luggage fees, service charges or facility charges, room services, minibar, entertainment, personal charges, damage to the hotel room, security fees, gratuities, taxes, and/or other expenses, will be at the Customer’s sole expense, unless expressly provided otherwise in the applicable Reward or Elite Rewards Gift description. Customer is solely responsible for obtaining all forms of insurance (including, without limitation, travel insurance) at their option and hereby acknowledges that DraftKings has not and will not obtain or provide any form of insurance. Details of each Reward and Elite Rewards Gift may be modified by DraftKings in its sole and absolute discretion, at any time and for any reason or no reason. Customers will be responsible for all incidental charges associated with their redeemed Rewards and Elite Rewards Gifts. Each Customer shall be responsible for providing any necessary information to DraftKings and/or any third-party Rewards or Elite Rewards Gifts provider, as necessary, and notifying DraftKings and/or such third party of any changes to such information, including, without limitation, a change of address. DraftKings is not responsible for any lost, stolen, or damaged Rewards or Elite Rewards Gift. Each Customer acknowledges that provision of Rewards and/or Elite Rewards Gifts may be delayed or made impossible for any reason, including reasons outside of DraftKings’ control. DraftKings will not be responsible for delays of Rewards and/or Elite Rewards Gift that cannot be provided due to impossibility. DraftKings will not be liable for its failure to comply with any provisions of this Policy due to reasons outside of DraftKings’ control. Each Customer acknowledges that there are factors and occurrences that may impact or affect the safety of any events, activities, or travel associated with redeemed Rewards and/or Elite Rewards Gift, including, but not limited to, SARS-CoV-2 and any variants thereof (“COVID-19”), and each Customer assumes all risk associated with such factors and occurrences, including those of serious injury, illness, death, and travel delay and associated costs.

ALL REWARDS AND ELITE REWARDS GIFTS ARE AWARDED AS IS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW (OR MAY LIMIT) DISCLAIMERS OF CERTAIN WARRANTIES, IN WHICH CASE THE DISCLAIMER IN THE PRECEDING SENTENCE WILL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

All Rewards and Elite Rewards Gifts are for the exclusive use of the recipient. Rewards and Elite Rewards Gift may not be sold, transferred, assigned, or gifted to any other person or entity. Any attempt to sell, transfer, or gift a Reward or Elite Rewards Gift, or any part of a Reward or Elite Rewards Gift, may result in disqualification and forfeiture of the Reward or Elite Rewards Gift at the sole and absolute discretion of DraftKings, for any reason or no reason. Customer’s receiving Rewards and/or Elite Rewards Gift (and their guest(s) in the event applicable) may additionally be required to sign an assumption of risk or waiver in order to receive the Reward or Elite Rewards Gift.

For any Reward or Elite Rewards Gift involving attendance at an event, experience, and/or travel:

• Customer is responsible and liable for all acts or omissions of Customer and Customer’s guest(s) (in the event any) in connection with Customer and Customer’ guests attendance and participation in the Reward or Elite Rewards Gift.
• Customer must follow, and are responsible for ensuring Customer’s guest(s) (in the event any) follow, all policies, instructions, and requirements of DraftKings and any venues, hotels, or spaces associated with the Reward or Elite Rewards Gift while attending or participating in the Reward or Elite Rewards Gift, including, without limitation, health and safety protocols which may include vaccination requirements, testing requirements, wearing masks, and social distancing;
• Customer shall be responsible for ensuring that Customer’s guest(s) comply with all policies, instructions, and requirements of DraftKings and any hotels, spaces, and/or venues associated with the Reward or Elite Rewards Gift;
• DraftKings may prohibit Customer and/or Customer’s guest(s) (in the event any) from participating in or attending the Reward or Elite Rewards Gift, or any component of the Reward or Elite Rewards Gift, in the event Customer is unable to comply with or violate any policies, instructions, or requirements of DraftKings or any venues associated with the Reward or Elite Rewards Gift;
• Customer is solely responsible for determining and fulfilling any attendance eligibility requirements for Customer and Customer’s guests’ (in the event any) participation in or attendance at a Reward or Elite Rewards Gift, including, without limitation, any age requirements, and Customer acknowledges and agrees that DraftKings or any venues, hotels, or spaces associated with a Reward or Elite Rewards Gift may prohibit Customer or Customer’s guests’ (in the event any) participation in or attendance at a Reward, or any component of a Reward or Elite Rewards Gift, in the event Customer or Customer’s guest(s) (in the event any) do not meet all applicable eligibility requirements to attend the Reward or Elite Rewards Gift;
• DraftKings has the right to exclude or remove Customer and/or any of Customer’s guest(s) (in the event any) from participation in or attendance at a Reward or Elite Rewards Gift, or any portion of a Reward or Elite Rewards Gift, and/or deny admission to or remove Customer and/or Customer’s guest(s) (in the event any) from any hotels, venues, or spaces associated with a Reward or Elite Rewards Gift, as determined by DraftKings in its sole and absolute discretion, for any reason or no reason;
• Customer hereby acknowledge that Customer and any of Customer’s guest(s) (in the event any) may be required to sign additional waivers and/or releases related to Customer and Customer’s guests’ (in the event any) participation in or attendance at a Reward or Elite Rewards Gift as a pre-condition of Customer and Customer’s guests’ (in the event any) attendance at or participation in a Reward or Elite Rewards Gift;
• In the event DraftKings or any venues, hotels, or spaces associated with a Reward or Elite Rewards Gift deny Customer and/or Customer’s guest(s) (in the event any) entry to, remove Customer and/or Customer’s guests (in the event any) from, or otherwise prohibit Customer and/or Customer’s guests (in the event any) from attending a Reward, Elite Rewards Gift, or any portion of a Reward or Elite Rewards Gift, for any reason or no reason, DraftKings, its parents, subsidiaries, and affiliates, and the directors, officers, employees, agents, shareholders, other representatives, and successors and assigns of each of the foregoing will not be responsible for providing a replacement or otherwise compensating Customer for loss of the Reward, Elite Rewards Gift, or any portion of the Reward or Elite Rewards Gift.
• CUSTOMER REPRESENTS AND WARRANTS THAT ATTENDING A REWARD OR ELITE REWARDS GIFT IN PERSON IS WHOLLY VOLUNTARY, AND THAT CUSTOMER IS FULLY AWARE OF THE HAZARDS, DANGERS, AND RISKS INVOLVED, INCLUDING SERIOUS INJURY, ILLNESS, AND DEATH. BY ATTENDING A REWARD OR ELITE REWARDS GIFT IN PERSON, CUSTOMER ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND FURTHER ACKNOWLEDGE AND ACCEPT THE RISKS ASSOCIATED WITH OTHER FACTORS AND OCCURRENCES THAT MAY IMPACT OR AFFECT CUSTOMER’S HEALTH OR SAFETY, INCLUDING, WITHOUT LIMITATION, THE CORONAVIRUS (ALSO KNOWN AS COVID-19, 2019 NOVEL CORONAVIRUS) PANDEMIC AND OTHER DISEASES, ILLNESSES, VIRUSES, AND CONSEQUENTIAL HEALTH EFFECTS. IN PARTICULAR, CUSTOMER UNDERSTANDS AND ACCEPTS THE RISK THAT ATTENDING A REWARD OR ELITE REWARDS GIFT IN PERSON MAY EXPOSE CUSTOMER TO ILLNESS, INJURY, OR OTHER HARM, INCLUDING, WITHOUT LIMITATION, EXPOSURE TO COVID-19, WHICH CAN BE SPREAD, AMONG OTHER WAYS, VIA THE AIR, FROM PERSON-TO-PERSON CONTACT, AND/OR BY CONTACT WITH CONTAMINATED SURFACES AND OBJECTS. CONTRACTING COVID-19 CAN CAUSE INJURY, ILLNESS, DEATH, AND/OR DISABILITY, AND MAY REQUIRE OR RESULT IN THE NEED FOR MEDICAL TREATMENT AND/OR MAY RESULT IN A NEED TO QUARANTINE FOR A PERIOD OF TIME. CUSTOMER’S ATTENDANCE AND PARTICIPATION AT ANY IN PERSON REWARD OR ELITE REWARDS GIFT IS AT CUSTOMER’S OWN RISK, AND CUSTOMER ASSUMES FULL RESPONSIBILITY FOR ANY AND ALL ASSOCIATED RISK OF BODILY INJURY, DEATH, AND/OR ILLNESS, AND QUARANTINE AND TRAVEL-RELATED EXPENSES; and
• BY ATTENDING OR PARTICIPATING IN ANY IN PERSON REWARD OR ELITE REWARDS GIFT, CUSTOMER UNDERSTANDS AND AGREES THAT DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING LIMIT THEIR LIABILITY IN CONNECTION WITH CUSTOMER’S ATTENDANCE OR PARTICIPATION IN AN IN PERSON REWARD OR ELITE REWARDS GIFT AS SET FORTH IN THIS SECTION. UNDER NO CIRCUMSTANCES SHALL DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING BE LIABLE TO CUSTOMER OR CUSTOMER’S GUEST(S) (IN THE EVENT ANY) FOR ANY LOSS OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, EXEMPLARY, ECONOMIC, PUNITIVE, OR CONSEQUENTIAL DAMAGES) THAT ARE DIRECTLY OR INDIRECTLY RELATED TO CUSTOMER’S PARTICIPATION IN OR ATTENDANCE AT AN IN PERSON REWARD OR ELITE REWARDS GIFT, AND/OR CUSTOMER’S TRAVEL TO AND FROM AN IN PERSON REWARD OR ELITE REWARDS GIFT, EVEN IN THE EVENT FORESEEABLE OR EVEN IN THE EVENT DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, STRICT LIABILITY, TORT (INCLUDING, WITHOUT LIMITATION, WHETHER CAUSED IN WHOLE OR IN PART BY NEGLIGENCE, ACTS OF GOD, OR THEFT OR DESTRUCTION). IN NO EVENT WILL DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING BE LIABLE TO CUSTOMER OR ANYONE ELSE FOR LOSS OR INJURY, INCLUDING, WITHOUT LIMITATION, DEATH OR PERSONAL INJURY.

WAIVER

BY PARTICIPATING IN THE PROGRAM, REDEEMING REWARDS OR ELITE REWARDS GIFT, OR PARTICIPATING IN ANY EVENTS, ACTIVITIES, OR TRAVEL ASSOCIATED WITH A REWARD, ELITE REWARDS GIFT, OR THE PROGRAM, YOU HEREBY FULLY, KNOWINGLY, AND VOLUNTARILY RELEASE DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING, FROM ANY LIABILITY ASSOCIATED WITH THE ACCUMULATION, POSSESSION, REDEMPTION, USE OR ENJOYMENT (OR ATTEMPTED ACCUMULATION, POSSESSION, REDEMPTION, USE OR ENJOYMENT) OF ANY REWARD OR ELITE REWARDS GIFT, INCLUDING ANY PROPERTY DAMAGE, EMOTIONAL DISTRESS, ILLNESS (INCLUDING COVID-19), DISEASE, PERSONAL INJURY, AND DEATH. ALL TRAVEL, LODGING, EVENT PARTICIPATION, USE, AND/OR ENJOYMENT OF REWARDS, ELITE REWARDS GIFTS, AND ASSOCIATED ACTIVITIES WILL BE PERFORMED AT YOUR SOLE RISK AND RESPONSIBILITY, AND YOU HEREBY FULLY, KNOWINGLY, AND VOLUNTARILY ASSUME THE RISK THEREOF AND RELEASE DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING, FROM ANY LIABILITY ASSOCIATED THEREWITH.

A Customer’s eligibility for the Program, their Crowns balance, Tier Credits, tier status, participation in Elite Rewards, and/or Elite Rewards Credits may be revoked or modified by DraftKings at any time, in DraftKings sole and absolute discretion, for any reason or no reason, and DraftKings may, without limitation and in addition to any other rights or remedies available to DraftKings under this Policy or under applicable law, withhold, revoke, or require you to return any Rewards and/or benefits awarded or given to a Customer in connection with the Program.

INDEMNITY

BY PARTICIPATING IN THE PROGRAM OR ACCEPTING ANY REWARDS OR ELITE REWARDS GIFTS IN CONNECTION WITH THE PROGRAM, YOU AGREE TO INDEMNIFY, PROTECT, DEFEND, AND HOLD HARMLESS DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING, FROM AND AGAINST ANY AND ALL THIRD-PARTY CLAIMS, LIABILITIES, LOSSES, DAMAGES, INJURIES, DEMANDS, ACTIONS, CAUSES OF ACTION, SUITS, PROCEEDINGS, JUDGMENTS, AND EXPENSES, INCLUDING REASONABLE ATTORNEYS' FEES, COURT COSTS, AND OTHER LEGAL EXPENSES, INCLUDING, WITHOUT LIMITATION, THOSE COSTS INCURRED AT THE TRIAL AND APPELLATE LEVELS AND IN ANY BANKRUPTCY, REORGANIZATION, INSOLVENCY, OR OTHER SIMILAR PROCEEDINGS, AND ANY OTHER LEGAL EXPENSES ARISING FROM OR CONNECTED WITH YOUR PARTICIPATION IN THE PROGRAM, ANY USE AND/OR ENJOYMENT OF REWARDS OR ELITE REWARDS GIFTS, EVENT OR ACTIVITY PARTICIPATION OR TRAVEL ASSOCIATED WITH ANY REWARDS OR ELITE REWARDS GIFT, ANY PAYMENT METHODS USED, ANY FUNDING OF YOUR DRAFTKINGS ACCOUNT, AND/OR YOUR PARTICIPATION IN ANY DAILY FANTASY SPORTS (INCLUDING, WITHOUT LIMITATION, DRAFTKINGS PICK6) CONTEST OR ANY SPORTSBOOK, DK HORSE, AND/OR CASINO WAGER.

REPRESENTATIONS AND WARRANTIES

By participating in the Program and/or accepting any Rewards or Elite Rewards Gifts, you represent and warrant to DraftKings that: (i) you understand, agree to, and will abide by the Agreement in regard to the Program, the redemption of Crowns, the redemption of Elite Rewards Credits or Elite Rewards Gifts, and the receipt of any Rewards, Elite Rewards Gifts, and/or benefits associated with the Program (ii) you will abide by all applicable laws in the jurisdiction where you are located while participating in the Program (including entering any contests and making any wagers), Rewards, or Elite Rewards Gift, (iii) you are of the age of majority as required by applicable law or regulation, (iv) you are a legal resident of the United States or Canada, and (iv) you are, while performing a Crown Earning Activity, physically located in a US state or Canadian province or territory in which daily fantasy sports contests, sports betting, iGaming, and/or horse wagering, as applicable, are either expressly permitted by all applicable laws and regulations or not prohibited by the same.
